1. Acceptance of Terms

By accessing and using Butterlink ("the Service"), you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Butterlink provides a link management service that creates short links designed to escape in-app browsers on social media platforms. The Service allows you to:

• Convert long URLs into short, shareable links
• Track click statistics for your links
• Access links that open in native browsers instead of in-app browsers
• Display accurate link previews on social media, messaging apps, and tools such as Notion or Slack — by proxying the Open Graph metadata of the destination URL through our servers

Link Preview (OG Proxy): When a crawler or preview bot visits a Butterlink short URL, our servers fetch the Open Graph metadata (title, description, image) from the final destination and serve it as the preview. This request originates from Butterlink's servers, not from the viewer's device. Preview data is cached for up to 24 hours. We do not guarantee the accuracy or availability of link previews, as destination websites may block or alter their metadata at any time.

3. Acceptable Use Policy

You agree NOT to use Butterlink to:

• Distribute Malware: Links containing viruses, trojans, spyware, or other malicious code
• Phishing: Links designed to steal credentials, personal information, or financial data
• Illegal Content: Links to content that violates local, national, or international laws
• Spam: Mass unsolicited link distribution or automated bot usage
• Fraud: Deceptive schemes, scams, or misleading content
• Adult Content: Pornography or sexually explicit material (blocked by default)
• Gambling: Illegal online gambling or betting sites (blocked by default)
• Piracy: Copyright-infringing content, torrents, or file-sharing sites
• Hate Speech: Content promoting violence, discrimination, or harassment
• Drug Trade: Illegal drug sales or distribution

4. Service Limitations

To ensure fair usage and prevent abuse:

• Rate Limits: Maximum 10 links per minute per IP address
• Daily Limits: Maximum 100 links per 24 hours per IP address
• Security Verification: Cloudflare Turnstile may be required after multiple link creations
• Link Expiration: Links with zero clicks are automatically deleted after 90 days
• Inactive Links: Links with no new clicks for 2 years are automatically deleted

5. Content Filtering

We employ automated content filtering using URLhaus and other threat intelligence sources to block malicious URLs. While we strive to prevent harmful content, we cannot guarantee 100% accuracy. Users assume responsibility for clicking any shortened links.

6. User Responsibilities

You are responsible for:

• The content of destination URLs you shorten
• Compliance with laws in your jurisdiction
• Keeping your access tokens secure (for stats viewing)
• Not circumventing rate limits or security measures
• Respecting intellectual property rights

7. Service Availability and Reliability

While we strive for high availability, Butterlink is provided "as-is" without warranties of any kind. We do not guarantee:

• Uninterrupted service availability
• Error-free operation
• Permanent storage of links (see Section 4)
• That in-app browser escape will work on all platforms

8. Termination and Suspension

We reserve the right to suspend or terminate access to the Service, with or without notice, for:

• Violation of these Terms of Service
• Violation of the Acceptable Use Policy
• Suspected fraudulent, abusive, or illegal activity
• Technical or security reasons

Links may be disabled or removed without prior notice if they violate our policies.

9. Intellectual Property

Butterlink and its original content, features, and functionality are owned by Peter Jakubek and protected by international copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the Service's code
• Reverse engineer the Service
• Use the Butterlink name or logo without permission
• Create derivative works without authorization

10. Privacy and Data Protection

Your use of Butterlink is also governed by our Privacy Policy, which explains how we collect, use, and protect your data in compliance with GDPR and applicable data protection laws.

11. Limitation of Liability

To the maximum extent permitted by law, Peter Jakubek and Butterlink shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from destination URL content
• Service interruptions, errors, or delays
• Third-party security breaches

Our total liability shall not exceed €100 or the amount you paid for the Service (if applicable).

12. Indemnification

You agree to indemnify and hold harmless Peter Jakubek, its affiliates, and service providers from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your violation of any laws or regulations
• Content you link to through the Service
• Infringement of third-party rights

13. Dispute Resolution

Governing Law: These Terms are governed by the laws of Vienna, Austria, without regard to conflict of law principles.

Jurisdiction: Any disputes shall be resolved in the courts of Vienna, Austria.

EU Users: EU consumers have the right to pursue disputes through the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of modified terms. Material changes will be notified through the Service or via email (if provided).

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Peter Jakubek regarding the Service and supersede all prior agreements.
